Helena has extensive experience in both personal and corporate insolvency matters, as well as general commercial litigation and Corporations Law matters.
Her abilities range from the simple such as issuing and setting aside statutory demands and winding up applications, through to more complex matters.
Helena’s experience and abilities include:
- Acting for creditors in the Supreme and District Court against liquidators for uncommercial transactions, voidable transactions
- Acting for and against liquidators in actions against directors for insolvent trading
- Validation of administrators’ and liquidators’ appointment
- Appointment of provisional liquidators
- Applications for approval of remuneration
- Deregistration of companies and release of liquidators
- Conducting public examination
- Acting for directors of companies in proposing a deed of company arrangement
- Advising directors of their duties under the Corporations Act
- Advising receivers, administrators and liquidators with respect to their duties, powers and responsibilities
- Obtaining freezing orders
- Disputes between company directors and shareholders
- Minority and majority oppression claims
- Advising directors as to their duties, powers and responsibilities
In addition Helena has acted for trustees in bankruptcy on most matters under the Bankruptcy Act, as well as debtors, for example defending s139ZQ notices, preferential payment claims etc.
Helena’s general commercial litigation expertise also includes matters such as:
